Q. Can an Applicant/Respondent take out Restraining/Protection Order?
A. Yes. This can be done at The Family Court if the application is coupled with another Magisterial application, otherwise that application should be made at any other Magistrate’s Court within the person particular Magisterial district.
Q. Can anyone make an application for Protection/Restraining Orders on anyone other than husband/boyfriend, wife/girlfriend at the Family Court?
A. No, the Domestic Violence Act specifically states under Section 3 and Section 4 that a person’s Protection Orders are granted to persons who are members of a household or was in a relationship.
