ORDER 60

APPEALS TO THE COURT OF APPEAL FROM THE REGISTRAR OF TRADE UNIONS

Appeal to be Brought by Originating Summons

1. An appeal to the Court of Appeal by any person aggrieved by a refusal of the Registrar of Trade Unions to register a combination as a trade union or by the withdrawal or cancellation of a certificate of registration shall be made by summons which shall set out in general terms the grounds of appeal and the provisions of Order 32, rules 2,4, and 5, shall with such modifications as may be necessary, apply thereto and references therein to the Court shall be construed as references to the Court of Appeal.

Summons to be Supported by Affidavit

2. The summons shall be supported by an affidavit of such facts as it may be necessary to state to enable the Court of Appeal to decide the question before it.

Time for Appealing

3. The summons shall be filed with the Registrar within 8 days of the decision or order complained of and shall be served together with copies of the affidavit in support of the Registrar of Trade Unions at least 14 days before the date of the hearing set out in the summons.

Power to Amend Summons

4. The Court of Appeal or a single Judge thereof shall have power to amend the summons upon such terms (if any) as the justice of the case requires.

Departure from Rules

5. (1) Without prejudice to its powers under Order 3, rule 5, the Court of Appeal may direct a departure from the rules of this Order in any way where this is required in the interest of justice.

(2) The time for delivering, amending or filing any pleading, answer or other document may be enlarged by consent in writing, without application to the Court of Appeal or a single Judge thereof.

Orders made on Hearing of Appeal to be Filed and Served

6. All orders made on the hearing of an appeal shall, unless the Court of Appeal otherwise directs, be drawn up by the Registrar and be filed by the successful party within 7 days from the date that the order was made and the Registrar shall forthwith cause to be delivered to the Registrar of Trade Unions a sealed copy of the order so filed as aforesaid.
