ORDER 58 APPEALS FROM THE REGISTRAR AND ASSISTANT REGISTRARS Appeals from certain decisions of Registrar, etc., to Judge in Chambers 1. (1) Except as provided by Order 62, rule 35, any person aggrieved by an order or decision of the Registrar or an Assistant Registrar in the exercise of the jurisdiction conferred on him by Order 32, rule 18, may appeal therefrom to a Judge in Chambers. (2) The appeal shall be brought by serving on every other party to the proceedings in which the order or decision was given or made a notice in writing to attend before the Judge on a day specified in the notice. (3) Unless the Court otherwise orders, the notice must be issued within 5 days after the order or decision appealed against was given or made and served not less than one clear day before the day fixed for hearing the appeal. (4) Except so far as the Court may otherwise direct, an appeal under this rule shall not operate as a stay of the proceedings in which the appeal is brought. (5) Subject to paragraph (6) if there be no Judge sitting in Tobago at the time when such appeal is made, all documents in the case shall be forthwith sent by the Assistant Registrar of Tobago to the Registrar to be laid before a Judge in Chambers. (6) Where the regular sitting of the High Court in Tobago is so near as to render the transmitting of the proceedings to Port-of-Spain unnecessary or inexpedient or in any case when the parties consent, the Assistant Registrar of Tobago shall retain the same to be submitted to the Judge on his arrival.
