Applications made in the Family Court High Court
An Application for access can be made where an Applicant does not have legal custody and is being denied the opportunity to share in the child's company, or where the Applicant informally has access but wishes to formalize the terms of access in a Court Order.
ATTACHMENT OF EARNINGS ORDER
An application for attachment of earnings can be made where the Applicant wishes the Court to direct the Respondent's employer to deduct maintenance payments Ordered by the Court.
BREACH OF ORDERS
An Application for Breach of Order can be made where there is an infringement or violation of an existing Order.
An application can be made under the Cohabitation Relations Act. Cohabitation is generally defined as two people living together as a married couple.
An application for legal custody can be made where an Applicant wants to have or share custodial rights. Custodial rights is the responsibility to provide for the child's care and control, namely the duty of providing food, shelter, medical care, education and discipline.
Legal Custody however, should be differentiated from 'actual custody' or 'de facto custody' or care and control of a child for, although an Applicant may have actual custody or care and control that is, "actual possession" of the child in their care, he/she may still need to apply to the Court for legal custody for custodial rights to be vested in him/her under law.
This is the dissolution (end) of a marriage. Under the Laws of Trinidad and Tobago the sole ground for divorce is that the marriage has broken down irretrievably.
An application for legal custody can be made where an Applicant applies for an Order of the Court to be named as the legal guardian with care and control of minor, child(ren) or an adult who is unable to care for themselves.
An application for maintenance can be made where an Applicant applies for financial support by the Respondent for the Applicant and/or the child(ren) of the family.
An application for a Paternity Order can be made where an Applicant applies for an Order of the Court declaring the man to be the father of the child(ren), whether born or unborn. The person wanting to establish paternity can either be the mother, father, or child.
An application for property settlement is where an Applicant makes an application for the rights to property that the couple obtained either before or during the marriage.
VARIATION OF AN EXISTING ORDER
An application for variation of an existing Order can be made where an Applicant wishes to change the terms of an existing Order.
An application for wardship can be made where an Applicant wishes the Court to exercise powers of guardianship.
